Alejandro Nicholas Mayorkas (born November 24, 1959) is a Cuban-American government official and attorney who has been serving as the seventh United States Secretary of Homeland Security since February 2, 2021. During the Obama administration, he also served in the Department of Homeland Security, first as director of United States Citizenship and Immigration Services (2009–2013), and then as deputy secretary of DHS (2013–2016).

Mayorkas was born in Havana, Cuba. Shortly after the Cuban Revolution, his family fled to Florida and later settled in California. He graduated from UC Berkeley in history with honors, subsequently earning his J.D. from Loyola Marymount University. After law school, Mayorkas worked as an Assistant United States Attorney and was appointed the United States attorney for the Central District of California in Los Angeles during the administration of President Bill Clinton and George W. Bush, where he oversaw the prosecution of high-profile criminal cases.

Mayorkas was a member of the presidential transition team for Barack Obama before he assumed office in January 2009, where he led the team responsible for the U.S. Department of Justice’s Criminal Division. Mayorkas was appointed by President Obama as the director of U.S. Citizenship and Immigration Services (USCIS). On May 20, 2009, the nomination was received by the Senate; on August 7, 2009, the nomination was confirmed by the Senate by voice vote. As USCIS director, Mayorkas led United States citizenship through management efficiencies and fiscal responsibility, and safeguarded the integrity of the immigration system. He implemented the Deferred Action for Childhood Arrivals (DACA) process in sixty days. He led U.S. government efforts to rescue orphaned children following the January 2010 earthquake in Haiti and led the advancement of a crime victims unit that, for the first time, resulted in the ability of the agency to administer the statutory maximum number of visas to victims of crime.

In 2016, Mayorkas became a partner at the law firm of Wilmer Cutler Pickering Hale and Dorr, in their Washington, D.C., office. On November 23, 2020, President-elect Joe Biden announced he would nominate Mayorkas as secretary of homeland security in his Cabinet. Mayorkas’s nomination received the endorsement of the Fraternal Order of Police and former secretaries Tom Ridge, Michael Chertoff (who served under George W. Bush), Janet Napolitano and Jeh Johnson (under whom Mayorkas served), who said Biden “could not have found a more qualified person”. On February 2, 2021, Mayorkas was confirmed by the Senate on a 56–43 vote, with significant Senate Republican opposition. He was sworn in by Vice President Kamala Harris on February 2, 2021. Mayorkas is the first immigrant and first person born in Latin America to lead the department.

Secretary of Homeland Security

Testifying to the Homeland Security Subcommittee of the House Committee on Appropriations on April 27, 2022, Mayorkas confirmed that the Biden Administration will implement a “Disinformation Working Group” in the DHS with the intention to “develop guidelines, standards, [and] guardrails” to shape the department’s longstanding effort to counter disinformation. Three weeks later, after critics called the initiative “a violation of free speech” and its executive director Nina Jankowicz had resigned, the Disinformation Woking Group was “paused”.

DISINFORMATION GOVERNANCE BOARD

The Disinformation Governance Board (DGB) was an advisory board of the United States Department of Homeland Security (DHS), announced on April 27, 2022. The board’s stated function is to protect national security by disseminating guidance to DHS agencies on combating misinformation, malinformation, and disinformation that threatens the security of the homeland. Specific problem areas mentioned by the DHS include false information propagated by human smugglers encouraging migrants to surge to the Mexico–United States border, as well as Russian-state disinformation on election interference and the 2022 Russian invasion of Ukraine. On May 18, the board and its working groups were “paused” pending review, and board head Nina Jankowicz resigned, as a result of public backlash, mostly from the political right, although criticism also came from progressives and civil libertarians. On August 24, 2022, Department of Homeland Security Secretary Alejandro Mayorkas disbanded the board.

Background

The Disinformation Governance Board was announced and revealed to the public by the DHS on April 27, 2022, during a 2023 budget hearing before the United States House Appropriations Subcommittee on Homeland Security. The board had begun operating two months prior to the announcement. The DHS had decided to form the board in 2021 after conducting research that recommended creating a group to “review questions of privacy and civil liberty for online content”. White House Press Secretary Jen Psaki said that the board is the “continuation of work that began in the DHS in 2020 under former President Trump”. The Cybersecurity and Infrastructure Security Agency has previously addressed the spread of what they referred to as “mis-, dis-, and malinformation”, as well as addressing Russian disinformation as part of their election security efforts in 2020. CISA director Chris Krebs was fired by President Trump in November 2020 for refuting Trump’s false claims of election fraud.

After the board was announced, Nina Jankowicz was named executive director. She was previously a fellow at the Wilson Center, advised the Ukrainian Foreign Ministry as part of the Fulbright Public Policy Fellowship, oversaw Russia and Belarus programs at the National Democratic Institute, and wrote the book How to Lose the Information War: Russia, Fake News, and the Future of Conflict. Robert P. Silvers and Jennifer Daskal were also named to hold leadership positions on the board. On May 18, Jankowicz resigned from her role as executive director.

Function

Alejandro Mayorkas, the Secretary of Homeland Security, stated that the board would have no operational authority or capability but would collect best practices for dissemination to DHS organizations already tasked with defending against disinformation threats, and asserted the board would not monitor American citizens. John Cohen, the former acting head of the intelligence branch of the DHS, said that the board would study policy questions, best practices, and academic research on disinformation, and then submit guidance to the DHS secretary on how different DHS agencies should conduct analysis of online content.

On May 2, 2022, the DHS released a statement which said that the board would monitor disinformation spread by “foreign states such as Russia, China, and Iran” and “transnational criminal organizations and human smuggling organizations”, and disinformation spread during natural disasters (listing as an example misinformation spread about the safety of drinking water during Hurricane Sandy). The DHS added that “The Department is deeply committed to doing all of its work in a way that protects Americans’ freedom of speech, civil rights, civil liberties, and privacy.”

On May 9, the DGB announced that it would provide quarterly reports to the U.S. Congress.

In the dystopian novel Nineteen Eighty-Four (1949), by George Orwell, the Thought Police (Thinkpol) are the secret police of the superstate of Oceania, who discover and punish thoughtcrime, personal and political thoughts unapproved by Ingsoc’s regime. The Thinkpol use criminal psychology and omnipresent surveillance via informers, telescreens, cameras, and microphones, to monitor the citizens of Oceania and arrest all those who have committed thoughtcrime in challenge to the status quo authority of the Party and the regime of Big Brother. Orwell’s concept of “policing thought” derived from the intellectual self-honesty shown by a person’s “power of facing unpleasant facts”; thus, criticising the dominant ideology of British society often placed Orwell in conflict with ideologues, people advocating “smelly little orthodoxies”.

In Nineteen Eighty-Four

In the year 1984, the government of Oceania, dominated by the Inner Party, uses the Newspeak language to control the speech, actions, and thought of the population, by defining “unapproved thoughts” as thoughtcrime; for such actions, the Thinkpol arrest Winston Smith, the protagonist of the story, and Julia, his lover, as enemies of the state. In conversation with Winston, O’Brien, a member of the Inner Party and a covert Thinkpol officer, reveals that the Thinkpol conduct false flag operations, such as by pretending to be members of the Brotherhood in order to lure out and arrest “thought criminals”.

As an agent provocateur, O’Brien gives Winston a copy of the forbidden book, The Theory and Practice of Oligarchical Collectivism, by Emmanuel Goldstein the enemy of the state of Oceania; yet the factual reality of The Brotherhood in Oceania remains uncertain, because O’Brien refuses to tell Winston whether or not the Brotherhood exists. The book explains that “Nothing is efficient in Oceania except the Thought Police,” as the Thinkpol is the only apparatus that must function effectively for the Party to retain control. There is a telescreen in the quarters of every Inner-party and Outer-party citizen, by which the Thinkpol audio-visually police their behaviour for unorthodox opinions, and to spy visible indications of the mental stresses manifested by a person struggling with ownlife, such as words spoken whilst asleep. The Thinkpol also spy upon and eliminate intelligent people, such as the lexicographer Syme, who is rendered an unperson despite his fierce loyalty to the Party and to Big Brother.

To eliminate possible martyrs, men and women of whom popular memory might provoke anti–Party resistance, thought-criminals are taken to the Miniluv (Ministry of Love), where the Thinkpol break them with conversation, degradation (moral and physical), and torture in Room 101. In breaking prisoners, the Thinkpol coerce their sincere acceptance of the Ingsoc worldview and to love Big Brother without reservation. Afterward, the Thinkpol release the politically rehabilitated prisoners to the social mainstream of Oceania. If the released thought-criminals are found to have committed more thoughtcrimes, the Thinkpol re-arrest them for further interrogation and torture, and eventual execution that concludes with cremation into an unperson.

Moreover, every member of the Inner Party and of the Outer Party who ever knew, was acquainted with, or knew of any unperson must forget them, lest they commit the thoughtcrime of remembering an unperson. Such crimestop, ideological self-discipline, of not thinking independently, indicates the cultural success of the Newspeak language as a means of social control. Moreover, the Minitrue (Ministry of Truth) destroy all records of unpersons. The Thinkpol usually do not interfere with the lives of the Proles, the working classes of Oceania, but do deploy agents provocateurs to operate amongst them, by planting rumours to entrap and identify and eliminate any Prole who shows intelligence and the capacity for independent thought, which might lead to rebellion against the cultural hegemony of the Party.
